§ 1 Scope
These Terms and Conditions apply to all orders placed via monomentberlin.com with Monoment Studio Berlin. We sell exclusively to consumers within the meaning of § 13 of the German Civil Code (BGB).
The version of these Terms valid at the time of your order applies.

§ 3 Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order.
By clicking the "Buy now" button (or equivalent) at checkout, you make a binding offer to purchase the items in your cart.
We will confirm receipt of your order by email immediately. This confirmation of receipt does not yet constitute acceptance of your offer. The contract of sale is concluded when we expressly confirm acceptance of your order or dispatch the goods.
§ 4 Prices and Payment
All prices are final prices in Euro (EUR).
Note on VAT: In accordance with § 19 of the German VAT Act (small business regulation), no VAT is charged or shown.
Shipping costs are shown separately during the ordering process.
The following payment methods are available:

The purchase price is due upon conclusion of the contract.
§ 5 Shipping and Delivery
We currently deliver to Germany and Austria.
Delivery time is generally 1–3 business days from dispatch confirmation. Different delivery times will be indicated on the respective product page or during the ordering process.
The safety and warning information on our products is provided in German. We are currently unable to accept orders from other countries.
§ 6 Retention of Title
The delivered goods remain our property until the purchase price has been paid in full.
§ 7 Right of Withdrawal
As a consumer, you have a statutory right of withdrawal. The detailed withdrawal instructions and the model withdrawal form can be found on the "Returns & Withdrawal" page.
§ 8 Warranty
Statutory warranty rights apply. In the event of material defects, you can contact us within the statutory periods.
Please inspect your order upon receipt. If a product arrives damaged or faulty, contact us at info@monomentberlin.com – we will find a solution.
We accept no liability for damage resulting from improper handling, storage or use of the candles. Please observe the safety instructions on the packaging.
§ 9 Liability
We are liable without limitation for damages arising from injury to life, body or health resulting from a negligent or intentional breach of duty by us, as well as for other damages resulting from an intentional or grossly negligent breach of duty by us.
For damages arising from the breach of essential contractual obligations (obligations whose fulfilment is essential to the proper performance of the contract and on whose observance you may regularly rely), we are also liable for simple negligence, but limited to the foreseeable damage typical for the contract.
Any further liability is excluded. The provisions of the German Product Liability Act remain unaffected.
§ 10 Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR), which you can access at https://ec.europa.eu/consumers/odr.
We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration body.
§ 11 Contract Language and Contract Text
The language for the conclusion of contract is German.
We will send you the contract text (your order with the applicable Terms and the withdrawal instructions) by email together with the order confirmation. The contract text is not stored beyond this. We recommend that you keep this email.
§ 12 Final Provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of your country of residence remain unaffected.
Should any provision of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
